These Terms of Service (the “Terms”) govern your access to and use of the Lume mobile apps, website (lumebeauty.ch) and related services (together, the “Service”), operated by Lume (“Lume”, “we”, “us”), a service of [COMPANY LEGAL NAME]. Please read them carefully.
1. Acceptance of these terms
By creating an account, making a booking through Lume, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service. If you use Lume on behalf of a business (a “Salon”), you confirm you are authorised to accept these Terms for that business.
2. What Lume is
Lume is a marketplace and technology platform that connects Customers with independent beauty, spa, and barber businesses (“Salons”) so Customers can discover services and book appointments. Salons are independent third parties, not employees, agents, or representatives of Lume.
Lume is not the provider of the beauty services. The services you book are performed by the Salon, which is solely responsible for them. Lume facilitates the connection and the booking; it does not control, supervise, guarantee, or take responsibility for the quality, safety, timing, or legality of any service a Salon provides.
3. Accounts & eligibility
You must be at least 16 years old (or the minimum digital-consent age in your country, if higher) to create an account and use the Service. You are responsible for the information you provide and for keeping your account and sign-in details secure. Keep your contact details accurate so that we and the Salons you book with can reach you. You are responsible for activity that happens under your account; notify us promptly if you believe it has been used without your authorisation.
4. Bookings, cancellations & payments
When you confirm a booking through Lume, you enter into an agreement directly between you and the Salon. Lume is not a party to that agreement.
- Salon policies. Availability, pricing, deposits, and cancellation and no-show policies are set by each Salon and shown to you before you confirm. By confirming, you agree to the applicable Salon policy.
- Payment. Lume does not currently process payments. Unless stated otherwise at the time of booking, payment is made directly to the Salon according to the Salon’s terms. Any dispute about charges, refunds, or the service itself is between you and the Salon.
- Be considerate. Please cancel or reschedule in good time so Salons can offer the slot to others. Repeated no-shows or abusive cancellations may lead to suspension of your account.
5. Acceptable use
You agree to use the Service only for lawful purposes, and not to:
- misuse, disrupt, or attempt to gain unauthorised access to the Service;
- submit false, misleading, or fraudulent information, bookings, or reviews;
- harass, threaten, or infringe the rights of Lume, Salons, or other users;
- copy, scrape, resell, or commercially exploit any part of the Service without our written permission; or
- upload anything unlawful, hateful, deceptive, or that you do not have the right to share.
6. User content & reviews
You keep ownership of the content you submit - such as reviews, messages, and photos. By submitting it, you grant Lume a non-exclusive, worldwide, royalty-free licence to host, display, and use that content in connection with operating and promoting the Service.
Reviews and other content you post must be truthful, based on genuine experience, and lawful. We may remove content that breaches these Terms, is fraudulent, or is reported and found to be abusive or misleading.
7. Salon obligations
If you use Lume as a Salon, you additionally agree to:
- keep your listings, prices, availability, and policies accurate and up to date;
- honour confirmed bookings and provide services with due skill and care, in line with what you advertise;
- hold any licences, registrations, and insurance required to provide your services lawfully, and comply with applicable health, safety, tax, and consumer law; and
- handle Customer information only as needed to fulfil the booking, and in accordance with applicable data-protection law.
8. Salon plans, fees & billing
This section applies if you use Lume as a Salon or as an individual professional (“Master”).
- Lume is free. Lume is currently provided to Salons and Masters free of charge.
- We may introduce a subscription at any time. Lume reserves the right to introduce a subscription or other fees for Salons and Masters at any time. We will give you reasonable prior notice before any such change takes effect.
- If you subscribe, you keep full access to all functionality of the Service.
- If you do not subscribe once a subscription is introduced, your public listing and page will not be shown on Lume until you subscribe. Your account and your data remain accessible to you, and you may export them at any time (see below) - you simply will not be publicly listed until you pay.
- No forced or retroactive charge. We will never charge you without your active agreement and valid payment details, and no charge applies for any period before you subscribe.
- Optional paid features. Separately, some features are optional and paid and apply only when you choose to use them - for example processing payments through Lume, promotional boosts, and additional team-member seats.
- Cancel & export any time. You may stop using Lume at any time and export your salon and client data - including client records and bookings - at any time.
9. Intellectual property
The Service - including the Lume apps, website, software, the “Lume” name and logo, design, and all related content other than user content and Salon-supplied material - is owned by Lume or its licensors and is protected by intellectual-property laws. These Terms do not grant you any right to use Lume’s branding or reproduce the Service except as needed to use it normally.
10. Third-party services
The Service may link to or rely on third-party services (for example maps, sign-in providers, or messaging). Your use of those services may be subject to their own terms, and Lume is not responsible for third-party content or services.
11. Disclaimers & limitation of liability
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Lume disclaims all warranties and does not guarantee that the Service will be uninterrupted, error-free, or that listings are complete or accurate.
Because Salons are independent providers, Lume is not liable for the services delivered by Salons, for any act or omission of a Salon or Customer, or for any dispute between them. To the fullest extent permitted by law, Lume is not liable for indirect, incidental, or consequential losses arising from your use of the Service. Nothing in these Terms limits any liability that cannot be limited by law, or any rights you have under mandatory consumer-protection law.
12. Changes & termination
We may change or update these Terms from time to time. If we make material changes, we will take reasonable steps to let you know, and we may ask you to review and accept the updated Terms before you continue using the Service. Continued use of the Service after changes take effect means you accept the updated Terms. You may stop using the Service at any time, and we may suspend or end access where these Terms are breached.
13. Governing law
These Terms are governed by, and construed in accordance with, the laws of Switzerland, and any disputes are subject to the exclusive jurisdiction of the courts there, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
